Terms & Conditions

For the remainder of these terms and conditions the definitions"we", "us", "our" and "ours" shall refer to SgM Electrosoft and "you", "your" and "yours" shall refer to the customer.

  1. Sales:
    1. SgM Electrosoft asserts that all products are sold and dispatched in good physical and working condition unless stated otherwise.
    2. Online Sales
      1. Orders will usually be dispatched within 7 days of acknowledging receipt of your order, you will receive e-mail notification when your order is dispatched.
      2. Online purchasers are entitled to a seven day cooling off period from the day you receive the goods, unless you notify us otherwise that day is assumed by us to be 3 days after dispatch for destinations within Europe and 7 days for destinations outside Europe.
        If you decide that you no longer want the items you must notify us within the cooling off period to qualify for a full refund subject to clause 3(b) and a 10% restocking fee.
      3. Please allow 28 days for delivery from the date your order was dispatched. In the event that your order does not arrive within this timeframe we reserve the right to send a replacement or refund as we deem appropriate.
        If a refund is issued ownership of the dispatched items will immediately revert back to SgM Electrosoft and in the event that the dispatched items subsequently arrive you should notify us at once and return the goods to us.
        In the event that replacements are dispatched with the acceptance by you of either the replacement or the original package (whichever arrives first) you relinquish any rights of ownership you may have had in regards to the other package and ownership of said package will be immediately return to SgM Electrosoft. Should the other package subsequently arrive you should notify us at once and return the package to us unopened.
      4. In the event that your order arrives physically damaged you should notify us immediately and if possible include photos of both the damaged goods and the packaging.
    3. Point Sales
      1. Purchases from us made in person at an event are not covered by the seven day cooling off period as you were able to view the condition of the products prior to purchase and discuss its suitability for your intended usage with us.
      2. We reserve the rights to restock point sales items in accordance with clause 3(b) and a 10% restocking fee providing the items are returned to us on the day of purchase and to review any such decision on a case by case basis.

  2. Repairs & Replacements:
    1. Jaguar controller overlays are not covered by the remaining terms and conditions in section 2, nor are any items produced by a third party which may occasionally be sold through us.
      1. In the event that any item(s) purchased do not appear to be functioning correctly please contact SgM Electrosoft, if the problem can not be resolved by correspondence we may request that the item(s) be returned to us for a detailed examination.
        If we determine that the returned item(s) failed due to a manufacturing or design defect the item(s) will usually be repaired or replaced free of charge as a act of good faith for a period of six months from the invoice date. If the problem occurs after the "good faith" period you will be liable for all of the cost of any repairs or replacement.
      2. If we conclude that the failure was caused by miss use, abuse, alteration, tampering or other forms of interference by you, you will be liable for the full cost of any repairs or replacement.
      3. Returned items shall remain the property of SgM Electrosoft until any fees charged for the repair or replacement of said items have been paid or for a period of three months after our request for such payment at which time we will assume that you no longer want the item(s) in question and will sell them in order to recover any costs we have incurred.
      4. We reserve the sole right to determine if a defective or damaged item is to be repaired or replaced and the extent of your liability for the cost of any such repairs or replacements.
        If we decide that you are not liable and a repair or replacement is not possible we will issue a refund instead, our decision in such matters is final.

  3. Returns & Refunds:
    1. Returns
      1. Wherever possible items should be returned in their original packaging.
      2. You are responsible for paying all charges associated with returning any item(s).
    2. Refunds
      1. For a full refund returned items should include all associated documentation and supporting items such as cables, power supplies and overlays.
      2. Refunds will only be paid upon our receipt of your returned order.
      3. Refunds will be paid in full minus any expenses incurred by us (e.g. PayPal transaction fees, replacement of missing items).
      4. We reserve the right at our discretion to offer any refund as either cash or credit.

  4. Warranty:
    SgM Electrosoft does not provide a warranty of any kind for any product manufactured by or purchased from us including, but not limited to the implied warranties of merchantability and fitness for a particular purpose.
    By making a purchase from us you accept that the goods are as stated and that the purchase and use of such goods by you is at your own risk and that we are not liable for any loss of data, loss of income, damages or injuries occurring from the use or miss use of any item produced by or purchased from us.

  5. Data Protection:
    SgM Electrosoft is permitted to retain certain non personal information about its customers in the course of its business (names, postal/E-mail addresses, phone numbers and purchase history) and are not required to sign up to the data protection act in order to do so.
    Although not required to sign up to the data protection act we will comply with the spirit of the act in that we will not knowingly sell, rent, hire, lease or otherwise divulge the information we hold on you to any third party without your prior knowledge and consent unless required to do so by law and that we will take reasonable steps to ensure that such information is not obtained from us electronically or otherwise without our knowledge.

  6. These terms and conditions are governed by the laws and jurisdiction of the United Kingdom and Northern Ireland. In the event that any clause or sub clause is deemed unenforceable by law all other clauses and sub clauses will remain in effect.
  7. These terms and conditions supersede any other terms and conditions provided by SgM Electrosoft in any form. SgM Electrosoft reserves the right to withdraw or alter these terms and conditions at any time without notice.
